The administration of justice in Colombia faces structural challenges due to a shortage of officials, especially judges, in the face of the high volume of cases that overwhelm the courts. In this context, artificial intelligence (AI) is emerging as a promising tool for modernizing and streamlining the judicial system, enabling legal professionals to intervene in cases more effectively and promptly. The ability to automate certain routine tasks can help alleviate court backlogs and optimize judicial management. <\/span> <\/span><\/p>

Legal and ethical challenges <\/strong><\/p>

The use of AI in law also raises significant legal and ethical questions. These include the risks of bias in algorithms that could lead to discrimination, the protection of personal data, transparency in the operation of systems, and liability for AI-assisted decisions. <\/span> <\/span><\/p>

These concerns demand the development and application of specific regulations that balance technological potential with the safeguarding of citizens’ fundamental rights.<\/span> <\/span><\/p>

Regulatory framework in Colombia <\/strong><\/p>

Colombia has begun to address this regulatory landscape:<\/span> <\/span><\/p>

  1. National Artificial Intelligence Policy (2019)
    Published by the Ministry of Information and Communications Technologies, it lays the foundations for the responsible and ethical development of AI, including principles relating to ethics, privacy and transparency. <\/span><\/li>
  2. Law 1581 of 2012 \u2013 Protection of Personal Data
    Establishes the general framework for the responsible handling of personal data, applying to public and private entities and protecting privacy against the use of automated technologies. <\/span><\/li>
  3. Code of Ethics in Artificial Intelligence (2020)
    Developed by the Colombian Association of Systems Engineers (ACIS), it proposes ethical principles for the development and use of AI, such as transparency, fairness, responsibility and non-discrimination. <\/span><\/li>
  4. Artificial Intelligence Bill (2021)
    Introduced in Congress, it seeks to create a specific regulatory framework for AI in sensitive sectors such as health, education and security, with an emphasis on privacy, non-discrimination and legal accountability. <\/span><\/li><\/ol>

    Implications for Law and Justice <\/strong><\/p>

    Implementing AI in the judicial system can transform the Colombian justice system, streamlining decision-making processes, improving the prediction of court outcomes, and optimizing document management. However, it is crucial to ensure that these technologies respect constitutional and legal principles, avoiding bias and guaranteeing the quality of decisions. <\/span> <\/span><\/p>

    The use of artificial intelligence in law represents a natural evolution of technology applied to justice.
