Statement to those affected by the cessation of operations of the company Viva Air

In compliance with the order issued by the First Civil Court of the Rionegro Circuit (Antioquia), by order dated March 9, 2023, the group action promoted by the users affected by the cessation of operations of the company Viva Air was admitted.

The class action was filed against the following responsible entities:

  • Viva Fast Colombia S.A.S., in charge of national operations.
  • Viva Airlines Peru SAC, in charge of international flights.
  • Avianca, as jointly liable.

The purpose of this action is to process the claim for corresponding compensation for the damages caused to users.

The process is being managed in the Civil Jurisdiction under the file number 05615310300120230006800 in the First Civil Court of the Rionegro Circuit.

In accordance with the provisions of Article 55 of Law 472 of 1998 —Collective Actions Law—, persons who are interested in becoming part of the group may register under the terms and conditions established by said law.

Likewise, those who wish to opt out of the collective action may also exercise their right in accordance with Article 56 of the same law.

We invite all those affected to learn about the development of the process and to make the decisions they deem appropriate regarding their involvement in this class action.
